3 Indenture between Sir William Plumpton and Henry Sotehill, 11 February
1464 (CB, 562)This indenture, made the xj day of February the third yeare of the
reigne of King Edward the iiijth betwene Sir William Plompton, knight,
on the one party, and Henry Sotehill, squier, on the other party,
witnesseth that the said Sir William hath granted, & by thes presents
granteth to the said Henry the keping & mariage of Elizabeth, cossin &
one of the heirs apparants of the said Sir William, that is to say
daughter of William Plompton, squier, son to the said Sir William.a
Also it is agreed betweene the said Sir William & Henry that John,
theldest son & heire apparent of the said Henry shall, with the grace
of God, take to wife the said Elizabeth, & the said Elizabeth shall, with
the grace of God, take to husband the said John; and in case that the
said John decesse, that then any son of the said Henry that shalbe
heire apparant to the said Henry shall take the said Elizabeth to wife,
and she him into husband, if the law of the Church will suffer it.Which Elizabeth the said Sir William hath deliuered to the said
Henry. For the house keeping & marriage of the said Elizabeth in the
manner & forme aforesaid, to be had, the same Henry hath paid to
the said Sir William c li, and shall, afore the feast of St Michaell
tharchangell next coming, find surety to the said Sir William, Brian
Rouclif & Sir Richard Hammerton, knight, by his seuerall obligacion,
to pay to them ccxxxiij li vjs viijd in the forme following, that is to say
xx li att the feast of the Natiuity of St John Baptist next coming, and
xx li at the feast of St Michaell tharchangell then next following, & xx
li att the feast of Pasche that shalbe in the yeare of Our Lord 1465;
and xx li att the feast of St Michaell that shalbe in the same yeare, and
xx li att the feast of Pasche that shalbe in the yeare of Our Lord 1466;
and xx li att the feast of St Michaell that shalbe in the same yeare, and
xx li att the feast of Pasche that shalbe in the yeare of Our Lord 1467;
and xx li att the feast of St Michael that shalbe in the same yeare, and
xx li att the feast of Pasche that shalbe in the yeare of Our Lord 1468;
and xx li at the feast of St Michael that shalbe in the same yeare, and
xx li att the feast of Pasche that shalbe in the yeare of Our Lord
1469; & xx marcs att the feast of St Michaell that shalbe in the same
yeare, vpon such condicion in euery of the said obligacions to be made,
that if the said Elizabeth dy afore the day of payment in any of the
said obligacions comprised, that then the same obligacion be voyd &
of none effecte. All which obligacions shalbe deliuered to the keeping
of Guy Fairfax by deliuery to them, the said Sir William, Brian &
Richard when the said Sir William shall haue made a feoffement of
manors, landes & tenements to the yearly value of xlvj marcs, after
thintent, use & effect hereafter following.And the said Sir William granteth to the said Henry by thes presents
that the said Sir William shall, afore the feast of St Michael tharchangell
next coming, make a do to be made by deed indented, whereof the
said Henry shall haue the one part a sufficient & sure estate to Bran
Rouclif, third baron the king’s exchequer, Richard Hammerton, knight,
George Darrell, knight, Richard Aldburgh, knight, John Gresley, knight,
Walter Wortesley, knight, Richard Fitzwilliam, knight, John Sotehill, of
Sotehill, squier, & Guy Fairfax to them & to their heires for euer, of
manors, landes & tenements to the yearly value of xl marcs ouer all
charges & reprises, they to haue the said manors, landes & tenements
in trust, & to thintent, vse & effect that if the said Elizabeth dy within
the age of xij years, that then the said Henry or his executors shall
haue & perceiue yearly the issues, rents, fermes and profitts of the
said manors, landes and tenements to the yearly vallue of xx marcs
immediately after the decesse of the said Elizabeth, during the life of
the said Sir William; & immediately after the decesse of the said Sir
William the said Henry or his executors shall haue & perceiue yearly
thissues, rents, fermes & profitts of the said manors, landes & tenements
to the yearly vallue of xl marcs vnto the tyme that the said Henry or
his executors shall haue taken & perceiued all such sumes of money as
it shall hap him to haue paid to the said Sir William for the said
marriage, for the said death, a parcell of the c li paid afore the date of
this indenture, as the residew in the forme aforesaid to be paid. And
that the said feoffez stand in the said feoffment, or other feoffez by
them to be made, to thuse of the said Sir William & his heirs after the
said money be content & paid.And the said Henry granteth to the said Sir William by thes presents
that if Margrett, sister to the said Elizabeth, dy without issue, the said
Elizabeth than being alife & within thage of xiiij years, and if the said
Sir William take a wife in time to come, & haue not issue masle by
her, than being in life, which ought to be his heire masle apparent,
that then the said Henry shall pay to the said Sir William ccc marcs,
that is to say within a yeare after the decesse of the said Margrett, c
marcs, if the said Elizabeth than liue & be within thage of xiiij yeares,
noon such heir masle had by the said Sir William in the forme aforesaid,
and within a yeare next sewing c marcs, if the said Elizabeth than
liue & be within thage of xiiij yeares, noon such issue masle had by
the said Sir William in the forme aforesaid; & within a yeare then next
sewing c marcs if the said Elizabeth then liue & be within thage of xiiij
yeares, none such issue masle had by the said Sir William in the forme
aforesaid.And if the said Elizabeth dy within thage of xiiij yeares, than such
payments as shall hap to be behind of the same ccc marcs not paid
cease, and pat for that some or payments of the said ccc marcs that
shall hap to be paid at the tyme of the death of the said Elizabeth, the
said Henry or his executors shall haue & perceiue yearly during the
life of the said Sir William xx marcs of the foresaid manors, landes and
tenements. And after his death xl marcs yearly of the foresaid manors,
landes and tenements vnto the time that the said Henry or his executors
be satisfied of as much money as it shall hap him to haue paid of the
foresaid ccc marcs, and that the same feoffees stand in the same
feoffment, or other feoffees by them to be made, to the same intent &
effect, and as parcell for repayment of the same ccc marcs, as for
repayment of the xc marcs abouesaid.And the said Sir William granteth to the said Henry by thes presents
that the said Henry or his executors shall take & perceiue yearly
thissues, rents, fermes & profitts of thes the said manors, landes &
tenements in forme aforesaid, parcell the payment afore rehersed,
without interupcion of the said Sir William, his heirs or assignes.
Moreouer, Sir William granteth to the said Henry by thes presents that
if hereafter the said Sir William take a wife and haue issues masle by
her which ought to be his heire masle apparant, that the said Henry
shall haue the keping & marriage of the same issue masle, to be married
to one of his daughters, for which marriage to be had the said Henry
to pay to the said Sir William cc marcs, that is to say the day of the
deliuery of the said issue masle to the said Henry c marcs, taking then
of the said Sir William sufficient surety that in case the said issue masle
dy afore the age of xiiij, that then the said Henry to be repaid of the
c marcs. And that day xij moneths after the said deliuery of the said
issue masle c marcs, taking then, in likewise, surety of the said Sir
William that in case the said issue masle dy after the said age, that
then the said Henry to be repaid of the said cc marcs.And the same Henry granteth by thes presents to the said Sir William
that he shall vnto John his son, or vnto him that shall hap to be heir
apparant vnto the said Henry, who shall hap to haue, or take into wife
the said Elizabeth, after the decesse of the said Henry & of Anne his
wife, of John Boyvile & Alinor his wife, landes & tenements to the
yearly value of c li in fe simple or fe taile, whereof the said Henry
shalbe seized, or other to thuse of the same Henry, or of him that shall
hap to be his heire apparent, wedded or to be wedded to the said
Elizabeth after the decesse of the said Henry, Anne, John Boyvile &
Alinor, his wife.And the said Sir William granteth by thes presents to the said
Henry, & faithfully promiseth that the same Sir William, nor any feoffe
to his vse shall not alien nor charge any landes or tenements whereof
he or any to his vse is seized but vnto him that by his said wif shalbe
vnto the said Sir William heire masle apparent, except the alienation
afore rehersed, and that it shalbe lawfull to the said Sir William to
giue & grant, or to make to be given & granted for terme of lyfe to his
wife that he shall wed in tyme to come, & to other certeine persons
landes & tenements to the yearly value of c marcs, whereof vnto
certeine persons to be named at the pleasure of the said Sir William,
landes & tenements to the yearly value of c marcs. And also vnto
Elizabeth, late the wife of the said William Plompton, squier, landes &
tenements to the yearly value of xl li for terme of life.And also the said Sir William granteth by thes presents to the said
Henry that he, nor none of his stirring nor comaundment for him,
shall perceiue nor stirre the said Elizabeth, nor Elizabeth hir mother
to disagre to the said marriage, but faithfully he hath promised to be
wele willed that they shall both agre to the said marriage.And to all these covenantes aboue rehersed to be performed of the
party of the said Sir William, the said Sir William byndeth himself &
his heirs to the said Henry by thes presents in vjc li of sterling. And all
these covenantes aboue rehersed to be performed of the party of the
said Henry, the said Henry bindeth him & his heirs to the said Sir
William by thes presents in vjc li of sterling. In witnesses whereof to
the one party of this indenture remaining toward the said Henry, the
said Sir William hath sett his seale. And to thother party of this
indenture remaining toward the said Sir William, the said Henry hath
